Kansas Collaborative Law Child Custody Attorney

Child Custody and Parenting Time

Child custody and parenting-time issues arise whenever parents live apart.

"Custody" means responsibility for decisions regarding a child's health, education and welfare. Parents may share custody. Or, if it's in the child's best interest, one parent may have sole decision-making power.

"Parenting time" means time a parent spends with the child. Regardless of where the child lives, each parent is entitled to reasonable parenting time unless it would endanger the child's physical, mental, moral or emotional health.

Child custody and parenting time issues typically come up in one of three contexts: a divorce, a paternity case or a custody proceeding between unmarried parents living apart.

Collaborative Law

In 20 years of practice as a family law attorney, I've that learned both sides generally want what's best for their children. This makes custody and parenting-time cases ideal for collaborative law resolution. In collaborative law, the parents and their lawyers use negotiation and mediation methods to find an equitable solution for both sides: acceptable results with as little trauma and conflict to the family as possible.

As a founding member of the Collaborative Law Institute of Kansas, I'm committed to helping clients resolve custody and parenting-time issues, through collaborative law when possible.

If collaborative law is not an alternative for you, then we would approach your case in the more traditional manner - litigation. I'm a very good litigator and I can take your case to court, however attempts to settle don't stop just because litigation starts. In Johnson County, for example, the parties must attend mandatory mediation before reaching the courtroom.

Child custody cases are handled in Family Court and the judges employ many alternatives, such as educational classes and home studies before conducting evidentiary custody trials. I represent clients throughout the process.

My Commitment to You and Your Children

If I represent you in a divorce, I'll strive try to keep your children's best interests at the top of the priority list. I'll give you my honest opinion about what I think is best for you and your children and I'll keep you updated about the progress of your case. Contact me at 913-890-2051 for a consultation.
